Terms of Service

1. Who we are

Aihangsoft ("we", "us") is an independent project operated by an individual developer, not a registered company. It operates the website at www.aihangsoft.top and the tools available on it. You can reach the operator at support@aihangsoft.top.

2. The service

Aihangsoft provides two kinds of tools:

• Browser tools. These run entirely in your browser. Your files are not sent to us. They are free and unlimited, and no account is required.
• Cloud AI tools. These require uploading your file to our server, which forwards it to a third-party AI service for processing. They consume credits and are subject to the limits described on our pricing page.

We may add, change or remove tools at any time. We do not guarantee that any particular tool will remain available.

3. Accounts

You may use the browser tools without an account. An account is required to receive the larger Cloud AI allowance.

• You must provide a valid email address and keep your password secure.
• You are responsible for everything done through your account.
• You must be at least 13 years old, and old enough in your country to enter into a binding contract.
• One person should not maintain multiple accounts to obtain additional free allowances. We may suspend accounts that do.
• We may suspend or close an account that breaches these terms or the Acceptable Use Policy.

4. Credits and plans

• Cloud AI usage is measured in credits. Different tools and models consume different numbers of credits, as shown on the pricing page and in the tool itself.
• Free accounts receive a daily allowance. Pro accounts receive a monthly allowance. Allowances do not accumulate: unused allowance expires at the end of each period.
• Purchased credit packs are added on top of your plan allowance and do not expire.
• Credits are consumed only when a cloud operation completes successfully. If a run fails, no credits are taken.
• Credits have no cash value, are not transferable, and cannot be exchanged for money.

5. Payments

Payments are processed by our reseller and Merchant of Record, Creem. When you buy a plan or credit pack, your contract for the purchase is with Creem, and Creem handles payment collection, invoicing, applicable taxes and related compliance. Prices are shown in US dollars. Depending on your location and payment method, your bank may apply currency conversion or other charges, which are outside our control.

6. Refunds and cancellation

• Subscriptions. You can cancel at any time from your account page, which links to the Creem customer portal. Cancellation stops future renewals; you keep access until the end of the period you have already paid for. We do not provide partial refunds for unused time within a billing period.
• Credit packs. Purchased credits are non-refundable once any part of the pack has been used.
• Faulty service. If a cloud operation fails, credits are not consumed. If you believe you were charged incorrectly, contact us within 14 days and we will investigate and, where appropriate, refund or restore credits.
• Statutory rights you may have under the consumer law of your country are not affected by this section.

7. Your content

You keep all rights to the files you process with Aihangsoft. We do not claim ownership of your images or videos.

By using a Cloud AI tool, you grant us and our service providers a limited licence to store, transmit and process your file for the sole purpose of delivering the result you asked for, and you confirm that you have the right to do so. You are responsible for ensuring you hold the necessary rights to any file you process. Do not use the Cloud AI tools on material you do not own or have permission to edit. See the Acceptable Use Policy.

8. Acceptable use

Your use of Aihangsoft is subject to our Acceptable Use Policy, which forms part of these terms. It prohibits, among other things, using the Cloud AI tools to create or process unlawful content, sexual or pornographic content, or imagery that depicts real people without their consent.

9. Third-party services

The Cloud AI tools use third-party AI processing services, and payments are handled by Creem. Our Privacy Policy identifies those providers. We are not responsible for the acts or omissions of third-party services, and their own terms may apply to you.

10. Availability

Aihangsoft is provided on an "as available" basis. We may interrupt, suspend or withdraw any part of the service for maintenance, capacity limits or reasons outside our control. Cloud AI tools depend on third-party capacity and may be rate limited, queued or temporarily unavailable.

11. Disclaimer

To the fullest extent permitted by law, Aihangsoft is provided without warranties of any kind, express or implied, including fitness for a particular purpose. AI processing is probabilistic: results vary, and we do not warrant that any output will be accurate, complete or fit for your purpose. You should always check results before relying on them.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US$50. Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Termination

You may stop using Aihangsoft at any time. We may suspend or terminate your access if you breach these terms or the Acceptable Use Policy, or if we are required to by law or by our payment or AI providers. If we terminate your account for a reason other than your breach, we will refund any unused credits you paid for.

14. Changes to these terms

We may update these terms from time to time. The "last updated" date at the top will change, and for material changes we will provide reasonable notice, for example by email or a notice on the site. Continuing to use the service after a change means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the People's Republic of China, and disputes may be brought before the competent courts there. This does not deprive you of the protection of mandatory consumer law in your country of residence, and you may also be entitled to bring proceedings there.
